Supreme Court Arguments on Brnovich v. DNC

 

 

  • Yesterday, the Supreme Court began hearing oral arguments on a key voting integrity case: Brnovich v. DNC. 
  • In partnership with the Arizona Republican Party, the RNC and other party committees have begun supporting this lawsuit as part of their ongoing commitment to restore election integrity and fight Democrat attempts to upend our elections processes. 
  • Democrats are trying to manipulate a key part of the Voting Rights Act. 
  • In Brnovich v. DNC, Democrats are asking the Supreme Court to transform the plain language of Section 2 of the Voting Rights Act which forbids election laws that discriminate on the basis of race, into a blank check that would allow for courts to strike down measures without limit. 
    • Using the Voting Rights Act as a tool to overturn race-neutral and minimally burdensome safeguards sets a dangerous precedent that further politicizes our courts and leaves states with fewer tools to administer safe and secure elections.
    • The impetus behind this request is two commonsense, race-neutral Arizona laws:
      • Arizona’s ban on ballot harvesting prevents bad actors with malicious intent from coercing or changing ballots; 
      • Its law requiring voters to vote in the correct precinct allows for the efficient administration of Arizona elections.
    • The RNC is supporting the Arizona Republican Party with legal expertise and the resources to hire top-tier, specialist Supreme Court advocates. 
      • The RNC, NRCC, and the NRSC have consistently worked with and supported the Arizona Republican Party in this important case since it was first filed in 2016.
  • Voters must have confidence in the integrity and legitimacy of our elections. The Supreme Court should reject Democrats’ efforts to weaponize the Voting Rights Act and prioritize partisan politics.
